Hiring your first employee: registrations come before the first paycheck

Registration, payroll setup and making tax deposits on time are three separate jobs.

Before the first payday, an employer typically needs an EIN, a federal payroll tax deposit plan, Form W-4 from each employee, Nevada unemployment insurance registration, Modified Business Tax registration, new-hire reporting and workers' compensation coverage. Always follow the current instructions from each agency.

Registering an account is not the same as setting up payroll correctly. Setting up payroll is not the same as making timely deposits and filings each period.

Whether someone is an employee or an independent contractor depends on the actual working relationship, not only on what a contract calls them.

Checklist

  • EIN and federal deposit schedule (IRS Publication 15)
  • Form W-4 and Form I-9 for each hire
  • Nevada UI employer account (DETR)
  • Nevada MBT registration
  • New-hire reporting
  • Workers' compensation coverage
  • Review worker classification

Common misconceptions

Myth: If I sign a contractor agreement, the worker is a contractor.
Reality: Classification depends on the facts of the relationship and should be reviewed.
